2. Subject matter of the Service
2.1. These GTC apply to the Provider’s online intelligent catalogue service, under which the User enters individual parameters on the web interface and the system generates possible axle solution proposals that may be ordered after agreeing on further commercial and delivery terms.
3. General provisions
3.1. These GTC govern the legal relationship between the User and the Provider.
3.2. Use of the service is subject to the User’s acceptance of these GTC.
4. Data processing and retention
4.1. The Provider uses the product data supplied by the User solely for the purpose of generating the axle solution.
4.2. Data are stored for the duration of the generation process and for 30 minutes after the confirmation e-mail has been sent.
4.3. After 30 minutes from dispatch of the confirmation e-mail, all data are automatically deleted.
4.4. In case of a quotation request, the data used to prepare the offer will be deleted immediately upon the User’s explicit written request.
4.5. Data processing is carried out in accordance with the GDPR and Hungarian data-protection laws. A detailed privacy notice is available on the website.
5. User rights
5.1. The User may request in writing the rectification, erasure or access to their data from the controller at info@bpwagrar.hu .
5.2. Requests for erasure are fulfilled within the statutory deadlines.
6. Limitation of liability
6.1. The Provider shall not be liable for typographical errors or damages arising from incorrect data provided by the User.
6.2. The service is provided to the best of our knowledge and ability; uninterrupted operation cannot be guaranteed.
6.3. Force majeure: The Provider is released from liability in the event of force-majeure circumstances (e.g. natural disasters, war, strike, fire, cybercrime, governmental actions, or other causes beyond the Provider’s control) that prevent or delay the provision of the service. Once the force-majeure event ceases, the Provider will promptly contact the User regarding further handling.
7. Intellectual property
7.1. The website (https://bpwagrar.com/), the solutions generated by the intelligent catalogue, and all related content are protected by copyright.
7.2. The User may use the axle solutions generated by the system for internal purposes; disclosure to third parties requires the Provider’s written consent.
7.3. The content generated by the intelligent catalogue does not constitute official technical design documentation. Reverse engineering, public disclosure, or reuse without the Provider’s written consent is prohibited.
8. Fees and payment terms
8.1. The Service is free of charge.
8.2. Using the intelligent catalogue does not create any commercial or financial obligation for either the User or the Provider.
8.3. Based on the User’s specific needs, the Provider may offer additional, fee-based services.
9. Amendments
9.1. The Provider may unilaterally amend these GTC and will inform the User via publication on the website.
9.2. Amendments take effect 15 (fifteen) days after publication unless otherwise stated by the Provider.
10. Warranty and liability
10.1. The application was developed by BPW-Hungária Kft. with the utmost professional care.
10.2. It was created to assist our customers in selecting the most suitable product.
10.3. BPW-Hungária Kft. guarantees that, following any subsequent order, the selected product will be delivered in accordance with applicable quality standards.
10.4. The purchaser bears full responsibility for ensuring that the product is suitable for the specific operating environment, intended use, and the end user’s requirements.
11. Electronic communication
11.1. The Provider communicates with the User electronically, including amendments to the GTC.
11.2. The User agrees that all communication shall take place exclusively by electronic means (e-mail, web interface).
12. Severability
12.1. If any provision of these GTC is invalid or unenforceable, the remaining provisions remain in effect.
12.2. The parties shall replace the invalid provision with one that most closely reflects the original economic intent.
13. Language versions
13.1. These GTC have been prepared in Hungarian.
13.2. In case of discrepancies between an informative foreign-language translation and the Hungarian version, the Hungarian text shall prevail.
14. Related policies
14.1. These GTC form an integral part of the Provider’s Privacy Notice.
14.2. By using the service, the User also accepts the provisions of the Privacy Notice.
